Fort Collins police performed their inspections at the 7pm deadline and confiscated large quantities on remaining medical marijuana products. Supports of medical marijuana spent hundreds of thousands of dollars and sued the city after the vote passed but with no success.

However, just outside the city limits it’s business as usual as dispensaries continue to operate. Many of the dispensaries from Fort Collins will relocate to new location such as Denver and Boulder.

The patients claim that the rules violate a constitutional amendment passed by Colorado voters in 2000 guaranteeing marijuana for people with certain medical conditions.

Patients say the pending rules violate patient privacy because of a requirement that pot shops record marijuana sales on video. The patients also argue that the laws wrongly give local cities and counties the ability to ban marijuana dispensaries.

“The real issue here is whether medical marijuana patients are going to be treated like people with debilitating medical conditions, or whether they’re going to be treated like potential criminals,” said Andrew Reid, a Denver lawyer who filed the lawsuit Wednesday.

The lawsuit is a petition to the state Supreme Court asking the court to throw out most of the pot laws before lawsuits are decided by lower courts. There’s no guarantee the Supreme Court will hear the lawsuit.

The challenge to Colorado’s looming medical marijuana rules, the most extensive considered in any of the 15 states that have authorized medical marijuana, has long been expected. However, not all in Colorado’s marijuana industry want the rules thrown out.

Several marijuana industry members helped write the rules for commercial pot shops headed for final approval in coming weeks. More than 700 dispensaries have applied for state licenses, which would require them to grow 70 percent of the marijuana they sell and follow strict protocols for videotaping all areas of the business where pot is stored, among other rules.

“I think there are some onerous provisions, but at the same time this is an industry that needs to be regulated,” said Brian Vicente, head of the marijuana-advocacy group Sensible Colorado. Vicente was a member of the committee that wrote the proposed rules.

A spokeswoman for the state Department of Revenue, which is implementing many of the rules, did not immediately return a call for comment on the lawsuit.

A lawyer who represents marijuana businesses but isn’t part of the lawsuit, Richard Gee of Black Hawk, said Thursday that marijuana laws passed by lawmakers likely go too far in limiting patient access and privacy. But he wasn’t sure the Supreme Court will take up the matter.

“It’s going to be a hot potato for them,” Gee said.

One of the plaintiffs in the lawsuit, Kathleen Chippi of Nederland, said she closed her marijuana dispensary last year rather than comply with the rules. She said she served 2,000 medical marijuana patients from her One Brown Mouse Parlor/ Cannabis Healing Arts dispensary but shut her doors rather than agree to seed-to-sale tracking and videotaping her clients.

Chippi said the state Legislature trampled on constitutional rights to marijuana when it tried to regulate the industry.

“We have rights, and we enjoyed those rights in Colorado for nine and a half years until the Legislature decided they knew better,” Chippi said.

Organizers anticipate the rally to draw tens of thousands of individuals, although police have usually estimated past rallies at fewer than 10,000 participants. The NORML convention will include a host of panel discussions – titles consist of “Pot-n-Politics,” “Marijuana Nation” and “The Feds, Marijuana and You” – capped by a keynote address from Colorado U.S. Rep Jared Polis.

The 420 Rally will also feature speeches – by nearby medical-marijuana attorney Robert Corry and California medical-marijuana activst Richard Eastman, amongst other people – live music along with a “hemp and body paint fashion show.”

Federal prosecutors accuse Corey Inniss, the owner of the Way to Grow chain of hydroponics stores, of supplying growing equipment from his stores to help set up several marijuana cultivation operations in homes from Boulder to Fort Collins.

In exchange for the equipment, Inniss received a cut of the operations’ proceeds, according to the documents.

Prosecutors accuse Inniss of taking the money he received from the marijuana operation and depositing it into business accounts for his hydroponics stores.

The court documents state that, between April 2005 and August 2006, Inniss made nearly $1.3 million in cash deposits into two Way to Grow bank accounts.

Authorities launched the investigation in August 2006, and recent filings suggest that the case may soon be resolved.

“The parties continue to be engaged in settlement negotiations and believe that a settlement is eminent as part of a global resolution involving criminal charges as well,” federal prosecutors wrote in a Dec. 3 status update filing in one of the forfeiture cases.

Both Jeff Dorschner, a spokesman for the U.S. Attorney’s office in Denver, and Mike Turner, a Drug Enforcement Administration spokesman, declined to comment on the case.

Jeralyn Merritt, an attorney for Inniss, said in a statement: “Mr. Inniss, Way to Grow and the Government have expended considerable time and effort over the past year to resolve their legal differences. We anticipate a full resolution within the next few months. Way to Grow will continue to operate in full compliance with the law.”

The investigation details appear in court documents in two asset forfeiture cases filed in federal District Court in Denver.

In the first case, federal prosecutors are seeking to seize five houses — one in Windsor, one in Erie and three in Fort Collins — where the growing operations are alleged to have been housed. In the second case, prosecutors are trying to seize $48,900 found at one of the houses.

In October 2009, federal agents raided nine houses connected with the case and seized 981 mature and starter marijuana plants, according to the documents.

The attorney for one of the alleged growers, Martin Pieper, asserted in one case filing that any cultivation at Pieper’s house complied with Colorado’s medical-marijuana laws.

Pieper’s attorney, Joseph Saint-Veltri, declined to elaborate when reached by telephone.
